Punishment of the crime
Defendant
F is the head of the G customs service corporation, and the defendant G customs service corporation is a corporation (O) established in Jung-gu Incheon Metropolitan City M B 229-1 for the purpose of implementing procedures related to the reporting of export, etc. of goods.
1. Defendant A, C, B, D, E, and F’s joint crimes of this case are those of the Republic of Korea: (a) upon request from the Republic of Korea to purchase the ginseng seeds from P, Q, R (S), T, etc., which are Chinese solicitation books for solicitation of Chinese nationals; (b) upon receipt of the purchase price of the ginseng seeds from the Republic of Korea and carrying them out to China, Defendant C, along with Defendant A, shall collect the ginseng seeds of 256,000 won (Korean equivalent to 44,800,000 won) in return; (c) upon receipt of the payment of the purchase price of the ginseng seeds from the Republic of Korea; and (d) Defendant C, with Defendant A, shall receive 10,000 won in return for the collection of the ginseng seeds from the Republic of Korea under his name; and (d) Defendant B shall, upon receipt of the payment of the seeds from Defendant A in return for export of the ginseng seeds from the ginseng warehouse; and (d) Defendant D, Defendant D, and Defendant E, respectively, who will export the seeds to Defendant A through customs clearance and other customs clearance.
A person who intends to take agricultural and fishery bio-resources included in the list to be approved for taking them out of the Republic of Korea prepared by the Minister of Agriculture and Forestry from among agricultural and fishery bio-resources shall obtain approval from the Minister of Food and Agriculture Affairs.
Defendant
A shall not obtain the approval of the Minister of Agriculture and Forestry, the Minister of Food and Agriculture, and the Minister of Food and Agriculture for the purchase price of ginseng seeds on July 17, 2013, 130,000 (the price shall be equivalent to 237,500,000 won in Chinese) from P, and the price for purchasing ginseng seeds on July 18, 2013.
