1. The plaintiff's claim is dismissed.

1. Basic facts

A. On January 17, 2006 and January 19, 2009, each of the instant insurance contracts was concluded between the Defendant and the Defendant as the insured (hereinafter “each of the instant insurance contracts”).

On May 3, 2013, the Plaintiff was transferred from Green Damage Insurance Co., Ltd. the rights and duties and contractual status based on the instant insurance contract according to a decision to transfer contracts by the Financial Services Commission.

B. After entering into each of the instant insurance contracts, the Defendant received the diagnosis of “the 2nd 4, 5, 6, and 7 on January 31, 2008 at B Hospital’s hospital 19 days from the same day to February 18, 2008,” and received from the hospital for the period of 19 days from the same day. As indicated in the attached list of the details of the hospitalization of the Defendant Hospital, the Defendant received from the hospital 510 days in total from January 31, 2008 to September 22, 2014, the Defendant received from the hospital 510 days in the name of the w ch marth, liver, liver, spathritis, spathrosis, frying, acute infection, acute infection, acute rheat, satum, defrat, defratium, defratitis, defratitis, kneeum kne, eel, eelumumum, etc.

The Defendant claimed insurance money on the ground of the above hospitalized treatment, and received total amount of KRW 48,876,144 from the Green Damage Insurance Co., Ltd. and the Plaintiff for total amount of KRW 48,876,144.

C. In addition to each of the instant insurance contracts, the Defendant entered into a multiple insurance contract with the insurance company as the insured as indicated below, and received a total of KRW 124,201,300 as the insurance money.

The contract is terminated within one month after the date of conclusion or conclusion of the contract among the defendant's insurance contract details asserted by the plaintiff.
