The Defendants revised part of the facts charged to the extent that it does not affect the Defendants’ exercise of defense rights.
Defendant
A was a member of the I Party, who operates J in the Gu of Ansan-si as a member of the I Party, and was a member of L who was a candidate for the K election district I in the 20th National Assembly election of the 20th National Assembly member implemented on April 13, 2016. Defendant B was a member of the I Party. Defendant C was a member of the said J Party, Defendant C was a volunteer of the above L candidate, and Defendant D and E was a member of the election campaign for the above L candidate.
Anyone shall be prohibited from distributing, posting, spraying, showing or posting documents, drawings, printed materials, etc. indicating the name of a political party or candidate, or the name of a political party, in contravention of the provisions of the Public Official Election Act, with the aim of influencing the election from 180 days before the election day to the election day.
1. Defendant A, B, D, and E’s joint crimes on April 4, 2016, around 50:30, Defendant A instructed Defendant D and E, a company employee, to distribute or spread the above name cards on the vehicle or path, and Defendant B, D, and E to take charge of distributing or spraying the above name cards in accordance with the above direction.
According to the above public offering, from April 4, 2016 to 16:00 of the same day, Defendant B distributed or spread approximately 200 copies of the above election name box to the mail box, entrance, etc. of the housing units around the O elementary school and P middle school located in Ansan-si N, and Defendant D, E distributed or spread the above election name box to the above mail box, etc. at the same time and at the above place.
Accordingly, the defendants are printed matters not in accordance with the provisions of the Public Official Election Act for the purpose of influencing the election.
