Defendants are not guilty.
Reasons
1. Facts charged;
A. Defendant A in occupational breach of trust is the actual manager of Victim I Co., Ltd. (hereinafter referred to as “I”) located in Cheongju-si considerable area of Cheongju-si, and Defendant B is the representative director of the victim I, and all of the tasks, such as accounting and accounting.
(1) The Defendants are obliged to faithfully manage the victim I’s property, such as not paying false service costs.
그런데도 피고인들은 그 임무에 위배하여, ㈎ 2010. 2. 1.경 위 회사 사무실에서 한 달 정도 일을 한 피고인 A의 아들 J에게 용역비 명목으로 600,000원을 지급한 것을 비롯하여 그때부터 2012. 5. 14.경까지 별지 범죄일람표 1 기재와 같이 위 J에게 총 49회에 걸쳐 합계 26,468,400원을 지급하고, ㈏ 2010. 3. 13.경 위 회사 사무실에서 실제로 일을 하지 않은 피고인 A의 아들 K에게 용역비 명목으로 450,000원을 지급한 것을 비롯하여 그때부터 2012. 5. 11.경까지 별지 범죄일람표 2 기재와 같이 위 K에게 총 11회에 걸쳐 합계 19,330,000원을 지급하였다.
As a result, the Defendants conspired in violation of their duties, thereby obtaining property benefits of KRW 23,768,400 from the above J, and obtained property benefits of KRW 19,30,000 from the above K, and suffered property damages equivalent to KRW 43,098,40 from the victim I.
(2) On February 7, 2011, Defendant A purchased the part of the purchase of land at a price higher than the market price in KRW 760,00,000 ( KRW 8,135,000) with the wife L of Defendant A around February 7, 201, for approximately 760,00,000 square meters of forest land in Chungcheongnam-gun, Chungcheongnambuk-gun, and around that time, the victim I decided to purchase the total of KRW 2,852 square meters of forest land and 8,622 square meters of forest and 8,474 square meters of forest and 0,000 square meters, which were divided
In such a case, the appropriate purchase price is ① (1) where the purchase price per 1 kilometer purchased by L is based on approximately KRW 8,135,00,000,000 ( KRW 68,935,99,000) and (2) neighboring city taxes claimed by the Defendants, i.e., Chungcheongbuk-gun, transacted on March 14, 2012.
