1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. On March 15, 201, the Plaintiff, as a doctor, established and operated “C convalescent Hospital” (hereinafter “instant hospital”) which is an institution providing medical benefits in Taean-gun, Chungcheongnam-gun, Chungcheongnam-gun, 201, and closed the business on February 11, 2014.
B. On June 28, 2013, the Daejeon Health Insurance Review and Assessment Service requested the Minister of Health and Welfare to conduct on-site investigations on July 3, 2013 after conducting on-site verification (hereinafter “on-site verification”) with respect to the instant hospital.
The Minister of Health and Welfare, from February 15, 2016 to February 19, 2016, conducted on-site investigations of the instant hospital (the period subject to investigation: from March 15, 2013 to May 2013, and from December 2013 to February 2014; hereinafter “instant on-site investigations”) and determined that the Plaintiff received medical benefits costs unfairly as follows:
