1. The plaintiff's claims against the defendants are all dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. The fact that the Plaintiff’s assertion is the cause of the claim is that Defendant C was the nominal owner of E Jumump Cargo Vehicles (hereinafter “instant cargo”). Defendant B was the husband of Defendant C, who actually operated the instant cargo vehicle.

After the cargo of this case was loaded and released in the form of a car, the structure was changed by loading in the form of a Jump dump. As a result, the maximum cargo loading capacity of the truck of this case decreased from about 25 tons to about 8.1 tons at the time of release, and the use of the vehicle was limited to the air transport from the general cargo transport.

The Plaintiff purchased the instant cargo vehicle from Defendant B via Defendant D, a broker for the sale of used freight cars. As such, Defendant B and D had concealed the above fact and had been 25 tons of the instant cargo vehicle, and it was allowed to transport the instant cargo vehicle to the Plaintiff, the Plaintiff by deceiving the Plaintiff and selling the instant cargo vehicle to the Plaintiff.

Therefore, the Plaintiff paid 101,183,544 won to Defendant C in the purchase price, and paid 8,056,356 won in the remaining installments to Aju Capital.

Therefore, the Defendants are jointly and severally liable to compensate the Plaintiff for damages caused by joint tort, or restore the original state to the original state, and to pay 109,239,900 won and damages for delay.

2. The evidence alone submitted by the Plaintiff is insufficient to acknowledge the fact that the Defendants deceptiond the Plaintiff, and there is no other evidence to prove otherwise.

Therefore, the plaintiff's assertion is without merit.

3. If so, the plaintiff's claim against the defendants in this case against the defendants is dismissed as it is without merit. It is so decided as per Disposition.
