Reasons
Punishment of the crime
On June 4, 2014, the Defendant was elected as a candidate for proportional representation belonging to the Cparty in the election of Jeju Special Self-Governing Province Council members, which was implemented on June 4, 2014, and registered as a candidate for the C Party Jeju Special Self-Governing Province election commission on May 16, 2014.
No person shall publish false facts about the place of birth, status, occupation, career, property, personality, conduct, activity, organization to which he/she belongs, etc. in favor of a candidate, etc. by means of a speech, broadcast, newspaper, communications, magazine, poster, propaganda document, or other means, with the intention of getting elected or having another
Nevertheless, on April 18, 2014, the Defendant submitted an application for recommendation of a candidate for the nationwide local election at the office of the Jeju-do political party located in Jeju-do, and submitted the curriculum vitae as attached documents at the 6th time from February 1980 to March 1982. However, the Defendant was merely a career of working as a guard in the E Hospital Foreign Affairs for about two years from around 1980 to around 2 years from around 1982, and submitted a resume stating the above career as if he had a career of working as a “professional nurse outside the E Hospital Foreign Affairs”. However, on May 14, 2014, the number of candidates for proportional representative Do council members of Jeju-do, Jeju-do, which was decided three times on May 14, 2014, designated two of the career experience stated in the election campaign bulletin as “E Hospital Foreign Affairs and nurses,” and accordingly, C political party was designated as a candidate for proportional representative 60 Jeju-do election commission with the Defendant’s career of Jeju-do.
Accordingly, the defendant published false facts about the candidate's career in favor of the candidate for the purpose of election.
