Reasons

1. Basic facts

가. 당사자들의 지위 (1) 원고들은 피고들과의 사이에, 아산시 A 아파트(이하 ‘이 사건 아파트’라 한다)에 관하여 분양계약(이하 ‘이 사건 분양계약’이라 한다)을 체결한 수분양자들이고, 피고 주식회사 씨엑스디(이하 ‘씨엑스디’라 한다)는 아산신도시 B지구 4, 6블록 개발사업의 건설 및 시행업 등을 주된 목적으로 설립된 법인으로 이 사건 아파트 4블럭 230세대, 6블럭 567세대, 합계 797세대의 분양사업을 시행한 시행사이자 분양자이고, 피고 엑스티엑스건설 주식회사(이하 ‘엑스티엑스건설’이라 한다)는 토목건축공사업, 주택건설사업 등을 주된 목적으로 설립된 법인으로 이 사건 아파트의 시공사이자 분양자이다.
