The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. The Defendant was unaware of the fact that the game machines installed in the amusement room operated by the Defendant was modified differently from the classified contents.

B. The sentence imposed by the lower court (one year of imprisonment with labor, two years of suspended execution, 160 hours of social service) is excessively unreasonable.

2. Determination

A. According to the evidence duly admitted and examined by the court below as to the assertion of mistake of facts, the following facts are acknowledged, and the defendant knew that the game of this case was altered and provided it to customers' use is sufficiently recognized. Thus, the defendant's assertion is without merit.
