1. The decision that the Defendant rendered to the Plaintiff on August 19, 2013 in addition to the intellectual disability grade shall be revoked.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Details of the disposition;
A. The Plaintiff undergone a surgery with chronic sulveymitis (native side) around April 1985 and December 198, 198, and received a decision on the disability grade 4 with hearing disability around August 2001.
B. Around July 2012, the Plaintiff filed an application for registration with a disabled person with a doctor B of the Jeollabuk-do Military Medical Center (hereinafter “Military Medical Center”) affiliated with the Defendant on July 17, 2012, along with a disability diagnosis certificate, etc. prepared by the Defendant. However, on September 6, 2012, the Defendant determined that the Plaintiff was unable to verify the intellectual disability according to the results of the National Pension Service’s examination by the National Pension Service. On October 9, 2012, the Plaintiff filed an objection with the Plaintiff along with B’s opinion and high school life records belonging to the Military Medical Center, but the Defendant rendered a decision against the Plaintiff on November 30, 2012, based on the results of the National Pension Service’s examination by the National Pension Service.
다. 원고는 2013. 4. 15. 피고에게 전라북도 C병원(이하 ‘C병원’이라 한다) 소속 의사 D이 2013. 4. 11. 작성한 장애진단서 등을 첨부하여 다시 장애인등록신청을 하였으나, 피고는 2013. 5. 13. 국민연금공단의 심사결과에 따라 원고에 대하여 지적장애 등급외 결정을 하였고, 이에 원고가 이의신청을 하였으나 피고는 2013. 8. 19. 국민연금공단의 재심사결과에 따라 원고에 대하여 ‘장애등급 판정기준상 지적장애는 웩슬러 지능검사 등 개인용 지능검사를 실시하여 얻은 지능지수에 따라 판정하며, 사회성숙도 검사를 참조하고, 뇌손상, 뇌질환 등 여러가지 원인에 의하여 성인이 된 후 지능저하가 온 경우에도 지적장애에 준한 판정을 할 수 있음. 제출된 자료를 바탕으로 재심사한 결과 2013. 4. 평가보고서상 지능지수 56으로 측정되었으나 2011. 11. 지능지수 80, 2012. 11. 지능지수 81로 측정된 점, 검사시 태도, 치료경과 등을 고려할 때 지적장애 등급에 해당되지 않는다’는 이유로 지적장애 등급외 결정을 하고, 2014....
