A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

From around 2000, the Defendant served as the management warden of the office “D” officetel in Suwon-si, Suwon-si, and has been in charge of the management of buildings.

The defendant manages each household owned by the victim E which has more than a majority of the above officetels, and is authorized by the lessee to newly recruit lessees to conclude a lease contract on behalf of the victim and to deliver it to the victim by receiving the deposit or rent for lease from the lessee, and is not delegated with the authority to conclude a new lease contract. As such, if there is a lessee who wishes to move into the above officetel, the defendant shall not receive the deposit or rent from the lessee without the consent of the victim, and shall inform the victim or the above F thereof so that the lessee may enter into a lease contract without the consent of the victim, and if the lessee would be paid the deposit or rent, the duty to deliver it to the victim.

Nevertheless, the defendant violated the above duties and entered into a lease contract with the lessee G around August 2008 at the above officetel management office around the victim's day, and transferred KRW 3 million from the above G to the agricultural bank (H) account in the name of the defendant on August 5, 2008. The defendant received KRW 200,000 per month from September 23, 2008 to February 3, 2010, and received KRW 200,000 per month from the above G and the above officetel 203 on January 19, 2010 to the day on which the deposit has been increased on February 10, 2010 to the day on which the deposit has been transferred from the above G to the day on which the rent has been transferred on around 200,000 won.
