1. The Defendant: (a) KRW 20,000,000 to Plaintiff A; and (b) KRW 12,00,000 to Plaintiff B and C; and (c) KRW 14,00,00 to Plaintiff D; and (d) each of the above costs.
Reasons
1. Basic facts
A. On September 30, 2012, the Plaintiffs and F entered into a sales contract with the Defendant on the following terms (hereinafter “instant sales contract”) with regard to the Busan Gangseo-gu Busan Metropolitan City G (hereinafter “instant land”) located within the land transaction permission zone, and the Defendant paid KRW 27,000,000 for the same day, and the Plaintiff A paid KRW 12,00,000 for the Plaintiff B and C, respectively, and KRW 14,000,000 for the Plaintiff D (hereinafter “each instant down payment”) and KRW 27,000,000 for the down payment.
Real Estate Sale Contract
1. Location of indication of real estate: 2,830 square meters in Busan Gangseo-gu G field;
2. Article 1 of the Terms and Conditions of the Contract (Sales Price and Time] 813,200,000 won down payment of KRW 85,00,000 shall be paid and received at the time of the contract. The remainder of KRW 72,820,00 shall be paid on November 23, 2012.
(A) Article 6 [Cancellation of Contract] Before the buyer pays the intermediate payment (if there is no intermediate payment agreement, the seller shall compensate the down payment in an amount equal to the total sum, and the buyer may waive the down payment and rescind this contract.
Article 7 [Non-performance of Obligations and Compensation for Damages] (1) In cases where a seller or a buyer has any default under this contract, the other party may demand in writing the person who has defaulted and rescind the contract.
(2) Where a contract is rescinded, the seller and the buyer may claim damages from the other party, respectively.
Except as otherwise agreed, the criteria of Article 6 shall apply.
(A) The land stipulated under a special agreement is a land transaction permission zone, and thus, the remainder after the land transaction permission is paid. The current obligation on the register shall be repaid at the time of any balance.
B. The Plaintiffs received a written consent from the Defendant to use the site, but no land transaction application for the instant land was received from the Gangseo-gu Office, the competent authority, until the date of closing the argument in this case.
