The action for retrial shall be dismissed.
The litigation costs for retrial shall be borne by the plaintiff.
Reasons
The ground for the petition for retrial asserted by the Plaintiff is apparent that it does not fall under any of the grounds for retrial under Article 451(1) of the Civil Procedure Act, which is applicable mutatis mutandis under Article 8(2) of the Administrative Litigation Act, and thus, the petition for retrial of this case
Therefore, we decide to dismiss the lawsuit of this case for retrial. It is so decided as per Disposition by the assent of all participating Justices.
