A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, together with C, was the representative director of D, and C was the head of the above company, and C was pretended to purchase necessary vehicles in the above company, and purchased the vehicle in the name of the above company by acquiring the vehicle from the financial company, and there was an invitation to sell the vehicle in another place and divide the money.

1. On September 12, 2007, at the point of two cars F for the company located in Gwangju Northern-gu, Gwangju, the head of the department of the above D, and C, as the head of the above D, proposed to purchase the company's office-use vehicle to the vehicle seller G, stated that he applied for an installment loan as security for the victim treatment Capital Co., Ltd., Ltd., which was kept at the same place, and submitted the application to the victim's name-free employee who is in charge of loan agency, and the defendant received the telephone from the above employee and responded to the defendant as if he faithfully pays the vehicle after the purchase of the vehicle.

However, even if the Defendant purchased an automobile through an automobile installment loan, it was thought that he would sell it again, and even if so, he did not have an intention or ability to faithfully repay the price.

Nevertheless, on September 12, 2007, the Defendant conspired with C to induce the victim to pay KRW 30,200,000 to the two vehicles for the said Bosch Rexton car, and acquired it by deceiving the victim.

2. Around September 12, 2007, Hyundai Motor I Agency in Gwangju-gu, Gwangju-gu, and C, as the head of the foregoing D, pretended to purchase a company’s business vehicle to the J of the Motor Sales Board, the victim Hyundai Capital Co., Ltd., Ltd., which had been kept there.
