1. Defendant B Co., Ltd.: 14,717,250 won and 5% per annum from June 21, 2018 to March 7, 2019.
Reasons
1. Basic facts
A. On April 14, 2015, D concluded a sales contract (hereinafter “instant sales contract”) with Defendant B (hereinafter “Defendant B”) by setting the sales price at KRW 490,575,000 with respect to the F Building G on the land outside the Young-gu E and four lots (hereinafter “instant commercial buildings”) at KRW 490,575,00.
B. On August 12, 2016, the Plaintiff entered into a contract with Defendant C, a licensed real estate agent, to purchase KRW 493,575,000 by adding a premium to the sale price (hereinafter “instant sales right sales contract”). On August 23, 2016, the Plaintiff lawfully succeeded to the status of the buyer upon obtaining approval from Defendant B on the resale of the said sales right.
C. At the time of the above sales contract for the right to sell lots, Defendant C displayed to the Plaintiff the sales plan (Evidence A 3, hereinafter “instant sales plan”) produced by Defendant B and distributed to real estate brokers via the sale counter-exercise. According to the above sales plan, the two pages of the instant commercial building were in contact with the outside in a glass window, and two columns were protruding out to the extent that other commercial buildings and walls are jointly owned.
Defendant B obtained approval for the use of the instant commercial building on March 31, 2017. At present, there are two additional columns on the wall side abutting on the outside and glass windows (hereinafter “instant additional columns”).
At the time of the contract for the commercial building of this case, the exclusive area was 64.642 square meters, but the non-use area due to the instant additional columns is 3.1 square meters.
