Reasons
1. The following facts shall be apparent or apparent to be recorded in this court:
1) The Plaintiff filed a lawsuit against the Defendants on April 7, 2014 against the Daegu District Court 2012Kadan50510, seeking the implementation of registration procedures for cancellation of the registration of the establishment of a neighboring mortgage that was completed by the Daegu District Court No. 10965, April 28, 2008. 2) The Daegu District Court rendered a judgment dismissing all the Plaintiff’s claims against the Defendants on January 7, 2014.
(hereinafter “The First Review Judgment”). The Plaintiff appealed to the said judgment by the Daegu District Court No. 2014Na2707, but the said court rendered a judgment dismissing all the Plaintiff’s appeal on September 25, 2014.
(hereinafter referred to as "the second review judgment"). The above review judgment became final and conclusive on October 16, 2014.
B. On October 17, 2014, the Plaintiff filed a lawsuit for the first retrial with the Daegu District Court 2014Na105 against the Defendants. The said court rendered a judgment dismissing the Plaintiff’s lawsuit for the retrial on May 8, 2015 (hereinafter “the first new judgment”).
(2) The Plaintiff appealed to the Supreme Court Decision 2015Da35430, but on September 24, 2015, the lower judgment became final and conclusive as it became final and conclusive after the final judgment of dismissal of the final appeal was rendered on September 24, 2015.
C. On October 14, 2015, the Plaintiff filed a lawsuit for the second retrial against the Defendants on October 14, 2015, and filed a petition for retrial seeking revocation of the judgment on the second retrial and the first new judgment. On June 2, 2016, the said court rendered a ruling dismissing the Plaintiff’s petition for retrial on June 2, 2016. (2) The Plaintiff appealed with Supreme Court Decision 2016Da29593, but on October 13, 2016, the said judgment became final and conclusive.
On July 6, 2017, the Plaintiff filed a lawsuit for re-deliberation 1) against the Defendants on July 6, 2017, Daegu District Court 2017 Jaena76 ( June 19, 2017).
