Reasons
1. Basic facts
A. On November 11, 1993, the Plaintiffs filed a report on the extension of a building on the attached list of 2,102.34 square meters (hereinafter “instant extension”) on the adjoining land of ten parcels, including the above building site, to the head of Seongbuk-gu Office on November 11, 1993, the extension of a building on the ground level 1 stories and 6 stories above the ground level 2,102 square meters above the ground level 2,102.34 square meters above the above ground level 10 square meters above the above building site. The Plaintiffs completed the extension construction of the instant extension on April 1994.
2) 현재 이 사건 증축물은 증축 공사 과정에서의 건축선 침범, 일조권 침해 등의 건축법 위반행위를 이유로 하여 미등기 상태에 있다. 나. 이 사건 증축물 지분에 대한 각 계약 체결 1) 이 사건 증축물 중 2/3지분에 해당하는 425평(≒636평 × 2/3)을 소유하고 있던 원고 A, B(이하 이들을 통틀어 칭할때는 ‘원고 A 형제’라 하고, 이 사건 증축물 중 이들 소유의 지분을 ‘이 사건 증축물 지분’이라 한다)은 2009. 2. 20. 피고와 사이에 이 사건 증축물 지분(425평) 중 5, 6층 소재 100평을 8,000만 원에 매도하는 계약을 체결하고(이하 ‘이 사건 매매계약’이라 한다), 같은 날 서초법무법인 등부 2009년 제322호로 인증을 받았는데, 이 사건 매매계약의 주요 내용은 아래와같다.
Article 5 (Methods of Payment for Sale Price) Purchase Price of KRW 80,000,000 shall be offset by the down payment of KRW 52,50,000,000, and the intermediate payment shall be paid KRW 5,000,000 within two days after the completion of notarial act, and the remainder 22,50,000 shall be paid immediately when the certificate of seal impression of the seller, which was not attached at the time of notarial act, is supplemented by documentary evidence.
Article 6 (Sales and Purchase Round of Unregistered Objects) Of the five floors, 60 square meters (20 square meters in possession of the defendant) among the six floors (20 square meters in possession of the defendant) 40 square meters in total (20 square meters in office size of the defendant 40 square meters in possession) 100 square meters.
