The defendant's appeal is dismissed.
Reasons
The summary of the grounds for appeal (fact-finding and misunderstanding of legal principles) is that the statements of victims and witnesses who correspond to the facts charged in this case are not reliable.
The physical contact between the defendant and the victim is consistent with the fact that the victim tried to have the mother of the defendant knife, and thereby prevented the defendant from doing so, and the defendant did not assault the victim as stated in the facts charged in this case.
In addition, the illegality of the defendant's act constitutes self-defense or legitimate act is excluded.
2. Determination
A. In light of the difference between the first instance court and the appellate court’s method of evaluating the credibility of a statement made by a witness of the first instance court in light of the contents of the first instance judgment and the evidence duly examined by the first instance court, or in exceptional cases where it is deemed significantly unreasonable to maintain the first instance court’s decision on the credibility of a statement made by a witness of the first instance court in full view of the results of the first instance court’s examination and the results of additional evidence examination conducted by the time of closing argument, the appellate court should not reverse without permission the first instance court’s decision on the grounds that the first instance court’s decision on the credibility of a statement made by a witness of the first instance is different from the appellate court’s decision (see, e.g., Supreme Court Decision 2006Do494, Nov. 24, 2006). In addition, the Defendant denied the facts charged by the lower court and the witness of the first instance in light of the following reasons.
