1. B With respect to the Defendant:

(a) On January 27, 2014, par value of KRW 100,000,000, the addressee, the defendant, the place of issuance, and the place of payment, respectively.

Basic Facts

On July 24, 2012, after the guarantee agreement, the Plaintiff entered into a credit guarantee agreement with C and D, and on October 31, 2012, the said companies performed the guarantee obligation under the said guarantee agreement to the creditor under the said guarantee agreement.

The plaintiff filed a lawsuit (Seoul Western District Court 2014Kadan226195) against the above company and the above company's joint and several liability for indemnity against the plaintiff, and on January 15, 2015, the judgment of the court below that "B, etc. shall jointly and severally pay to the plaintiff KRW 872,965,148 and damages for delay." The above judgment became final and conclusive around that time.

B A Promissory Notes (hereinafter referred to as “each of the Promissory Notes in this case”) were issued and delivered to the Defendant on January 27, 2014 as follows: (a) Promissory Notes issued and delivered “The Promissory Notes as of January 30, 2015,” “The Promissory Notes as of January 30, 2015.”

On January 27, 2014, when the issue date was issued and the payment date was due, each notarial deed (hereinafter “notarial deed”) that recognizes compulsory execution was prepared and executed by a notary public on January 27, 2014 with respect to the second bill as the law firm 2014 No. 85 on January 27, 2014, and as to the second bill as the law firm 163 on February 11, 2015.

With respect to the first bill, the Defendant issued an execution clause on February 4, 2014 and issued an execution clause on February 10, 2014, to KRW 100 million out of the claims, such as wages, etc. to the Suwon District Court 2014TT Industry Development Co., Ltd. (Seoul District Court 2014TTT2758) on February 10, 2014, and with respect to the second bill, the Defendant issued an execution clause on February 23, 2015 and issued an execution clause on February 26, 2015 and issued KRW 80 million out of the claims, such as wages, etc. to the Suwon District Court 2015TB on February 26, 2015, each of the instant claims attachment and assignment order on KRW 20 million.
