A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. 2016 highest 464;
A. On March 31, 2015, the Defendant against the victim F made a false statement that the Defendant: (a) on March 31, 2015, at the private office in the Dongjak-gu Seoul Metropolitan Government, the fact was that there was no pro-Japanese branch of the Bank; and (b) even if the Defendant did not intend to return the money received from the victim F even if the loan was not implemented, the Defendant received 50 million won in total, such as: (c) the Defendant received 30 million won from the Defendant’s company bank (Account Number: G) account in the name of the Defendant on the same day; and (d) the Defendant received 5 million won in total, such as having received 20 million won in the check through H on April 1, 2015, and received 50 million won in the face amount.
It is recognized that the defendant acquired 50 million won from F, and in full view of the following evidence, the defendant acquired 50 million won by means of account transfer on March 31, 2015, such as the receipt of 30 million won as a check through H on April 1, 2015, and the defendant also received 50 million won in total at the prosecutor's investigation stage, as above, at the prosecution investigation stage, it is recognized that the defendant received 50 million won in total at the prosecution investigation stage. Thus, the above correction is made.
B. On June 18, 2015, the Defendant against the victim I may grant a loan to the victim I up to KRW 700,000,00 as security to the forest land located in the Dobong-dong, Dobong-gu, Seoul Metropolitan Government, where it is difficult for the victim I to use the forest land as security and to return the money received from the said victim if the Defendant did not intend to do so because the forest land in the Dobong-dong, Dobong-gu, Seoul Metropolitan Government Dobong-dong is franchis, and the loan is not made
If 3,000 won is deposited, the loan will be made by June 30, 2015 and the loan will not be made.
