1. As to the cause of claim

A. 1) The Plaintiff is a registered titleholder of Jindo-gu Nexz Nexzer A tankler (hereinafter “instant vehicle”). 2) The Defendant purchased and occupied the instant vehicle from B on February 2011, and was stolen.

3) With respect to the instant vehicle, the Plaintiff received an administrative fine of KRW 37,080, KRW 34,200, KRW 1,020, KRW 34,200, KRW 34,200, KRW 34,200, and its additional charges in the year 2014, and KRW 1,020, and its additional charges due to the delay in the inspection of the instant vehicle from September 10, 209 to January 29, 2010, KRW 300, KRW 198,60, and its additional charges due to the failure to conduct regular inspections from March 2, 2012 to July 23, 2012, and paid the instant vehicle’s market price of KRW 5,00,000, KRW 94,200, and its additional charges).

B. Determination 1) The Defendant is liable to the Plaintiff for damages arising from infringement on the ownership of the instant vehicle, with 5,405,480 won (5,00,000 won per annum from the day following the delivery of the copy of the instant complaint to Oct. 17, 2014, registration license tax of 37,080 won per annum from March 17, 2013, automobile tax of 34,200 won from March 2014 to July 23, 2012, with 30,000 won from March 2, 2012 to 30,000 won per annum from the day following the delivery of the copy of the instant complaint, to pay 5,000 won per annum from the day following the judgment of this case to March 17, 2016, the statutory interest rate of 30,000 won from the day following the enforcement of the Civil Act, main sentence of Article 2(1)5, Paragraph 15, Article 2 of the Addenda of the former Act.
