1. On October 30, 2015, the defrauded: “B operates E Company 4 years, and the size of the company’s assets exceeds 20 billion won. The company is a plan to build and transfer a building in F around 2016 to around 2017, which is well in child birth and is easy to obtain shares information when entering a securities company. Furthermore, upon receiving investments from a securities company, the Defendant may pay investment proceeds of 20-30% per annum, and the principal may be guaranteed 99%.”

However, the Defendant did not have been operating a fund of KRW 150,000,000 as a professional investor with a capital of KRW 100,000,000,000 when retired from the workplace around May 2014. However, there was no intention or ability to receive money from the victim to pay the principal and interest of other investors and to guarantee the principal of the investment.

Ultimately, around October 30, 2015, the Defendant, by deceiving the victim as such, received KRW 30 million from the victim to the account in the name of the Defendant for investment, as well as obtained KRW 2,042,00,000 from the 11 victim to March 23, 2018, as shown in the attached crime list 1.

2. No person who violates the Act on the Regulation of Conducting Fund-Raising Business without obtaining authorization or permission, making registration or report, etc. under Acts and subordinate statutes, shall make an agreement to pay the total amount of investments or an amount in excess thereof to many and unspecified persons without obtaining any authorization or permission, or receive the investments

Nevertheless, the Defendant did not obtain authorization or permission, or make registration or report, etc., and sold on or around June 2014.
