Reasons
1. Facts of recognition;
A. The Plaintiff is an insurer who has concluded a comprehensive automobile insurance contract (hereinafter “instant insurance contract”) as shown in the attached Form with H and F car (hereinafter “Plaintiff vehicle”).
B. At around 07:20 on January 27, 2018, the Defendant, while crossing a bicycle crossing installed at the right edge of the crosswalk, along the bicycle crossing, along with the bicycle crossing installed at the right edge of the crosswalk, around C, where the signal of the crosswalk is red, coming to the upper intersection from the D apartment room to the upper intersection. 2. Determination
A. The summary of the parties' assertion 1) The accident of this case occurred due to the negligence of the defendant who entered the crosswalk in violation of the signal, and the driver of the plaintiff's vehicle who attempted to turn to the left by complying with the signal cannot be deemed to have any negligence. Thus, the plaintiff, the insurer of the plaintiff's vehicle, is not obliged to pay the insurance money to the defendant in compensation for the accident of this case. 2) The accident of this case by the plaintiff's driver who neglected the duty to take the front-time care of the accident of this case, concurrently occurs.
B. In light of the following facts and circumstances, the instant accident, in violation of red signal, is a bicycle riding road.
