1. The Defendants: (a) to the extent of the property inherited from the deceased C, each of the KRW 106,963,161, and among them, 9,90.
Reasons
1. Facts of recognition;
A. Upon entering into a loan contract as described below with the Plaintiff bank, C agreed to approve that the basic terms and conditions of bank credit transactions and the basic terms and conditions of deposit transactions apply, and to pay damages for delay as determined by the Plaintiff. The amount of loan in the loan section is extended on December 30, 2017, KRW 200,000,000,000 for household interest rate for repayment delay due to the date of loan extension, and KRW 11.8% per annum on December 30, 2017, the Defendant delayed the payment of the loan, and the details of overdue principal as of February 1, 2018 are as listed below.
The repayment date of the loan enforcement amount shall be 200,00,000 won in total of 13,94,745 won in total, 213,926,322 won in arrears, 14.14. 18,423 won in December 14, 2017, 19,981,57 won in total.
B. Inheritance 1) C died on May 23, 2017. On June 20, 2017, the Defendants, the heir of the first-class heir D and the lineal descendants of the first-class heir, renounced inheritance under Seoul Family Court 2017-Madan5179, and were the heir of the second-class heir (the lineal ascendants) (hereinafter “the deceased”).
(2) On November 23, 2017, the Defendants filed a report on the inheritance limited recognition with the Seoul Family Court 2017 Madan9391, and received a repair trial from the said court on March 19, 2018.

According to the above facts of determination, the defendants who jointly inherited the deceased are obligated to pay to the plaintiff 106,963,161 won (=213,926,322 won x 1/2) total amount of principal and interest of the debts corresponding to their respective shares in inheritance within the scope of property inherited from the deceased, and to pay damages for delay calculated at the rate of 11.8% per annum from February 2, 2018 (the following day of the calculation base date) to March 16, 2018 (the last delivery date of the copies of the complaint in this case) until February 2, 2018 (the date of the last delivery of the copies of the complaint in this case) and from the next day to the day of full payment (the rate of interest) to 15% per annum (the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings).
