Facts of recognition

The plaintiff is a company that runs the business of maintaining and managing facilities, and the defendant is a council of occupants' representatives comprised of representatives from each Dong of Daegu-gu B (hereinafter referred to as "the apartment of this case").

On October 16, 2019, the Defendant publicly announced a tender to select an enterprise (hereinafter referred to as “instant tender”) for the rupture repair and re-design construction of walls within the instant apartment building (hereinafter “instant construction”). The main contents of the public announcement are as follows.

The summary of the complex: The type of bidding for reference to construction specifications, which is conducted at the time of the on-site presentation, for general competition, electronic bidding, and the minimum time and place of presentation at the successful bidding site: On October 22, 2019, the participant at the on-site presentation meeting shall be the representative of the company at the on-site presentation meeting of the occupants' representative meeting on the date of receipt and opening of documents for the reduction of the number of employees and the letter of delegation; 1) the date of receipt of documents for the completion of the successful bidding on October 28, 2019, 200: the date of receipt of documents for the on-site presentation; 3) the date of and time of the successful bidding to the floor washing apartment; welfare facilities; other facilities re-construction; and other detailed matters shall be subject to the determination of the minimum qualification to participate in the bidding at the site; 1) the participant shall be fully specified as the successful bidder; 1) the participant shall be subject to the notification of the selection of the national land and other documents;

In October 28, 2019, 12 companies, including the Plaintiff, participated in the on-site presentation of the instant bidding site conducted on October 22, 2019, and five companies, including the Plaintiff, (hereinafter referred to as “instant tendering companies”), including the Plaintiff, are bid-related documents until October 28, 2019.
