Punishment of the crime

1. 폭력행위등처벌에관한법률위반(집단흉기등협박) 피고인은 2014. 11. 28.경 충남 예산군 C아파트 101동 903호인 피해자 D(여, 38세)의 집 거실에서 피해자가 자신과 사귀면서 다른 남자와 연락을 주고받으며 데이트를 한다는 이유로 말다툼을 하던 중 화가 나 양손으로 피해자의 목을 조르고, 주먹으로 피해자의 팔, 다리 등을 수회 때리고, 계속하여 부엌으로 가 그곳 싱크대 위 찬장에 있던 흉기인 과도(칼날 길이 10cm, 총 길이 20cm)를 들고 와 왼손으로 피해자의 뒷목을 잡아 누르고, 오른손에 든 과도를 피해자를 향해 든 채 “너 그 새끼 생각나서 이러지, 걔한테 가고 싶지 ”라고 말하여 마치 찌를 듯이 피해자를 협박하였다.

2.
