A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant is a person who was engaged in delivery and collection business from August 2010 to April 16, 2013 as the victim C, a corporation located in Daejeon Dong-gu, Daejeon, as a delivery agent.

1. On March 19, 2013, the Defendant embezzled KRW 22,610,447 from December 13, 2012 to April 12, 2013 as indicated in the attached Table 1 of the Crimes Day, including the consumption of gambling money from the day-to-day behavior to the day-to-day, while making cash payments of KRW 2,256,600 for liquor in the Emart located in Daejeon Seo-gu Daejeon, Daejeon, Daejeon, for the victim Co., Ltd., and embezzled it by consuminging KRW 22,610,47 from December 19, 2012 to April 12, 2013, while he/she was on duty for the victim.

2. From July 201 to April 2013, the Defendant: (a) was in charge of the business of receiving alcoholic beverage payments from customers to the Franart’s account; and (b) had deposited alcoholic beverage payments from the Fmaart’s side to the Fmaart’s Agricultural Account (G) for business convenience, he had been able to arbitrarily use the said alcoholic beverage payment using cash withdrawal function on the Fmaart’s liquor card while performing business by making payments using the Fmaart’s liquor card.

around February 15, 2013, the Defendant received KRW 1,00,000 from the said Frant for the sake of the victim Co., Ltd., and then withdrawn it around that time and consumed it as gambling money from the Daejeon World War, as shown in attached Table 2, and embezzled it by taking a sum of KRW 23,252,061, from February 15, 2013 to April 19, 2013, as shown in attached Table 2, from around 19 to around 23,252,061 as well as from February 15, 2013.

3. On November 2, 2012, the Defendant is obliged to deposit part of the money collected from the Fart to the company with the wind that arbitrarily uses it.
