The defendant's appeal is dismissed.

1. Therefore, the court below found the defendant guilty in spite of the fact that the defendant had a drunk driving. The judgment of the court below erred by misunderstanding the facts and affecting the judgment.

2. The following circumstances acknowledged by the evidence duly adopted and examined by the court below, i.e., ① at the investigative agency and the court of the court below waiting the defendant before the defendant’s house (the defendant was residing in Daejeon Middle-gu G multi-household house at the time) in order to receive the construction cost from August 15, 201; ② at around 22:00, the court below stated that the vehicle of this case was stopped before the house, the woman was placed at the front of the house, and the defendant was driven at the front of the house, and the defendant was driven at the house, and the defendant was coming to the vehicle after five minutes after the vehicle was driven. ② At the time of this case due to the problem that D was unable to receive the construction cost from the defendant, it was true that D did not make a false statement that D was under influence of alcohol, but the witness was consistently stated in the court below’s ruling.
