1. The Defendant’s KRW 24,117,58 and its interest to the Plaintiff are 5% per annum from January 24, 2017 to April 5, 2017.

1. Facts of recognition;

A. The Defendant filed an application for a construction permit with a plan to build a new factory of 120 square meters and its appurtenant facilities on B in Yongcheon-si, but returned to the problem of the area, the Defendant completed the construction report on December 22, 2014 with a size of 195 square meters, half the size of the factory, 84 square meters, and 90 square meters, which are affiliated facilities, as a whole.

The name of a construction project: The contract amount of May 15, 2015 (Amended by Presidential Decree No. 2620, Jul. 20, 2015): 160,000,000 won for the construction period of a new construction project (Amended by Presidential Decree No. 2620, Jul. 20, 2015): 160,000 won for the factory at 120,80,000 for the basic construction work; attached estimates of dormitory 27: 33,50,000 won for the steel frame construction - 39,200,000 won for the steel panel construction - 20,50,000 for the new construction period of a factory; and 160,000,000 won for a dormitory business - the total of 160,000,000 won for the dormitory business operation.

B. Next, on January 26, 2015, the Defendant entered into a contract with the Plaintiff on the construction of the said factory and its affiliated facilities (hereinafter “instant contract”). The details of the contract are as follows: 120 square meters in factories, 25 square meters in office, and 27 square meters in dormitories (excluding value-added tax).

At this time, the defendant presented the design plan for the factory area of 60 square meters used in the building report to the plaintiff, and once, ordered the construction of the 60 square meters of the factory according to the design, and the remaining 60 square meters of the construction to be carried out in the way that the two parts are added later.

C. Accordingly, the Plaintiff completed the construction of the factory (60 square meters), the office building, and the dormitory, and the Defendant completed the completion inspection on July 21, 2015.

In this process, in preparation for the extension of the factory, the Plaintiff conducted the construction of the foundation and the sn beam beam beamline on the basis of 120 square meters and added some construction works to the office and the lodging room, and accordingly, the construction cost required was assessed as KRW 30,667,558 (hereinafter collectively referred to as “additional construction cost”).

The defendant is about the area of the factory included in the contract of this case with the plaintiff.
