1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The defendant (appointed party, hereinafter "the defendant") holds an inaugural general meeting (hereinafter "the inaugural general meeting of this case") around July 20, 2003, consisting of descendants who jointly set up C, and the plaintiff and the designated parties are the members of the defendant's clan.
B. The right relationship of each of the instant lands in Ulsan-gu is 12,793 square meters of forest land and 17,256 square meters of forest land E (hereinafter “F-dong forest”) in Ulsan-gu.
On February 8, 1985, the transfer registration for ownership of 1/3 shares was completed to G, H, and I, who are descendants of C on February 8, 1985. On December 10, 1986, the transfer registration for ownership of 1/6 shares out of G, H, and I shares was completed on December 9, 1986 for G, H, and I shares. 2) On the other hand, the transfer registration for ownership was completed on December 30, 1986 for Ulsan Jung-gu M& 2,053 square meters (hereinafter referred to as "M land"; hereinafter referred to as "each land of this case" in common name with each forest of the Fdong, and the transfer registration for ownership was completed on December 30, 1986 for each share on December 16, 196.
3) After June 28, 198, K died on April 9, 1994, G and 1/6 shares of each of the instant land on July 10, 2003, the registration of ownership transfer was completed on the grounds of inheritance by agreement and division to N, andO as to each of the instant land. 4) After August 27, 2003, the registration of ownership transfer was completed on July 28, 2003 from all co-owners of the instant land to the Defendant on July 28, 2003, from the other co-owners except the Selected on September 16, 2003 to I, the registration of ownership transfer was completed on July 28, 2003.
C. The Korea Land and Housing Corporation, each of the instant lands of the Korea Land and Housing Corporation, incorporated each of the instant lands into a planned area for a PP rental housing project implemented by the Corporation, and accepted each of the instant lands to the Defendant on July 26, 2018, respectively.
