A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant knew that the Victim Construction Cooperatives deposited money in a corporate passbook of a specialized construction company, and then immediately deposited it, demanded the Victim Company to raise the transaction performance and receive fees. After having demanded the Victim Company to raise the transaction performance to the “C Stock Company” in which the Defendant actually operated, the Defendant, as soon as the money was deposited from the Victim Company, had the Defendant erroneously entered the passwords over several occasions, prevented the Victim Company from withdrawing due to a password error, and had the Victim Company arbitrarily withdrawn and consumed the passwords between the Defendant. At that time, the Defendant had the intent to arbitrarily raise the “C Stock Company’s business opening date” and “type of business” of the Victim Company’s business registration certificate in order to satisfy the qualification of a specialized construction business company as requested by the Victim Company.
