Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is the owner of Pyeongtaek-si B, C, D, and E.

1. Crimes related to the land of Pyeongtaek-si;

(a) No land use act which is not directly related to the production of agriculture or the improvement of farmland in the agricultural promotion district in violation of restrictions on acts in a specific use zone;

Nevertheless, on October 2012, the Defendant operated a fishery products wholesale facility (area 325 square meters) called “F” on the land in Pyeongtaek-si B, an agricultural promotion zone, and used land that is not directly related to agricultural production or improvement of farmland.

(b) Where it is intended to use farmland for other purposes within five years, which is used or used for the purpose of diversion of farmland after undergoing procedures, such as permission to divert farmland, the violation of approval for alteration of purpose of use, the head of a Si/Gun, etc.

Nevertheless, on April 30, 2012, the Defendant used the land of Pyeongtaek-si, which is used for the purpose of farmland-only distribution facilities for agricultural products, for the purpose of operating fishery products wholesale facilities (area 325 square meters) called “F” without obtaining approval from the head of Pyeongtaek-si around October 2012 after undergoing the farmland conversion permission procedure.

2. Crimes related to Pyeongtaek-si C and E land;

(a) No land use act which is not directly related to the production of agriculture or the improvement of farmland in the agricultural promotion district in violation of restrictions on acts in a specific use zone;

Nevertheless, on November 2014, the Defendant operated a restaurant (area 151 square meters) on the land in Pyeongtaek-si C and E, which is an agricultural promotion zone, and used land that is not directly related to agricultural production or farmland improvement.

(b) Where it is intended to use farmland for any other purpose within five years, which is used or used for the diversion of farmland after undergoing procedures, such as permission to divert farmland violating the purpose of use, the approval of the head of a Si/Gun, etc. shall be obtained;
