Reasons
Punishment of the crime
On March 14, 2006, the Defendant was the representative of the “ Incorporated Association C” established for the purpose of “the enhancement of the healthy life and quality of life of older persons and persons with disabilities,” etc. In March 14, 2006, on or around March 4, 2016, at the office of the said “ Incorporated Association C” among the police officers around March 2016, the Defendant should have deliberated and resolved on the case of the said association’s regular board of directors as an agenda item, but he did not present it as an agenda item and did not deliberate and decide on the case of the auditor’s reappointment. As such, the Defendant was aware that the minutes of the regular board of directors did not include “the case of the reappointment of the auditor” in the minutes of the board of directors, as proposed as an agenda item of the deliberation and resolution.
1. On March 2016, the Defendant: (a) instructed the Secretary-General of the Secretariat of the said Incorporated Association D to the effect that “if he/she had undergone the procedures for reporting to the representative director, he/she shall be required to newly prepare the minutes of the regular meeting of the board of directors as of March 4, 2016.”
3. Around March 25, 2016: Around March 4, 2016, the title "regular meeting minutes of the board of directors" consisting of the aforementioned D's "regular meeting minutes of the board of directors" using computers installed therein: A restaurant, E: six of the seven directors attend the meeting, F representative director, G director, H director, D director, I director, J director, bill No. 1: A resolution on settlement of accounts and performance records in 2015; A bill No. 2; A bill No. 3: A case of additional revision in 2016: A case of amendment of the operating rules of the corporation; A bill No. 4; a corporation auditor; other bill; a director's reappointment; a director's name and seal; and a director's name and seal; and a director's name and seal; and a bill No. 1 to 4; and a director's name and seal; and a director's name and seal were prepared within 30 years following the date of each resolution."
