Reasons
Punishment of the crime
1. From around 1997 to June 30, 2012, the Defendant entered into a sales contract with the actual representative of C Co., Ltd. (hereinafter “C”), which runs a steel wholesale retail business, and with the victim’s UN ethyl and steel products supply contract (D302), which is the former office of C on April 14, 2011.
However, at the time, C was in excess of the principal of financial rights equivalent to approximately KRW 3 billion and the interest rate of KRW 20 million per month, and the financial situation has deteriorated as it is difficult to procure steel products due to the difficulties in raising steel products.
Nevertheless, around December 19, 2011, the defendant continued to be supplied with additional iron plates from the victim in accordance with the above sales contract in Ansan-gu E, the present office of the C.
However, at the time of the additional supply, C's financial status has deteriorated, such as the credit purchase debt to the existing customers amounting to approximately KRW 1.3 billion, and even if it has been continuously supplied by the victim, there was no intention or ability to pay the price.
As such, the Defendant, by deceiving the victim, was supplied with the iron plates equivalent to KRW 2,010,168 at the market price on December 19, 201 by the victim, and had the victim receive from that time until January 25, 2012, the Defendant acquired the iron plates equivalent to KRW 147,681,634 at a total of 17 times as shown in the attached list of crimes from January 25, 201.
2. The Defendant was likely to be subject to compulsory execution, such as evading compulsory execution, by bearing a large number of accounts receivable, such as debt on steel sales, equivalent to KRW 147,681,634, etc.
In such a situation, the Defendant, at the end of February 2012, three copies of the electronic bill number G (e.g., face value G (e.g., face value) (e., face value 27,197,760 won) delivered from three enterprises, such as Seoba industry, etc., as sales proceeds to F who does not have any debt relationship at all.
