1. Upon a claim for change in exchange at the trial, the defendant shall provide the plaintiff with the real estate stated in the attached list.
Reasons
1. Facts recognized;
A. On August 13, 2014, A entered into a credit guarantee agreement with a credit guarantee foundation and a guarantee principal of KRW 10,000,000 (hereinafter “instant agreement”), and the credit guarantee foundation issued a credit guarantee certificate to A in accordance with the instant agreement.
B. The occurrence of a guarantee accident and the performance of the guaranteed obligation of the Credit Guarantee Foundation A, following the occurrence of a guarantee accident where A delays the repayment of the principal and interest of the loan granted by submitting the above credit guarantee statement, and the Credit Guarantee Foundation paid a deposit of KRW 10,000,000, interest of KRW 86,266, and KRW 10,086,266, to the National Bank of Korea on February 25, 2016, and subrogated the A’s obligation. 2) As of March 7, 2016, the amount of the indemnity claim against A by the Credit Guarantee Foundation is KRW 10,086,266, the amount of the indemnity claim against A is the sum of KRW 10,156,596,596, total amount of the guaranteed principal.
Meanwhile, under the instant agreement, A shall pay a deposit subrogated by a credit guarantee foundation to the repayment date by the rate prescribed by the credit guarantee foundation from the payment date to the repayment date. The delayed interest rate set by the credit guarantee foundation is 12% per annum from April 29, 2015 to the date.
C. A’s disposal of real estate 1) The real estate listed in the separate sheet owned by A (hereinafter “instant real estate”).
(B) As to the registration of ownership transfer in the name of the Defendant on September 10, 2015 (hereinafter referred to as “instant registration of ownership transfer”) under the name of the Government District Court No. 103156, Sept. 10, 2015 (hereinafter referred to as “instant registration of ownership”)
(2) At the time of the completion of the instant transfer registration, A’s active property was equivalent to KRW 82,00,000 at the market price of the instant real estate. Petty property was a small property, which is secured by the right to demand reimbursement against the Credit Guarantee Foundation, and KRW 10,086,266 at the time of the completion of the instant transfer registration, 70,000.
