A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 2, 2014, at around 20:50, the Defendant taken a photograph of the victim D (n, 18 years of age) and the victim E (n, b, 18 years of age) in the clive toilet located in Daegu-gu B and C, Daegu-gu, 2014, in a smartphone, in which the victim D and the victim E (n, b, c, 18 years of age) are reported. Besides, from July 19, 2014 to August 1, 2014, the Defendant taken a photograph of the non-named female as a smartphone additionally 14 times from July 19, 2014 to August 1, 2014.

Accordingly, the defendant taken the body of other persons who can cause sexual humiliation or sense of shame by using devices similar to the camera, against their will.

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);

A. On September 28, 2014, around 16:20 on September 28, 2014, the Defendant taken pictures of another person’s body, which might cause sexual humiliation or shame, by taking advantage of the galleno 3 mobile phone images owned by the Defendant, of the form in which the victim F (e.g., women, 21 years of age) reported the urine in the public toilets at C C, a 3rd floor located in Daegu-gu B, Seogu, Daegu-gu.

B. On October 19, 2014, around 03:38, the Defendant taken a photograph of another person’s body, which might cause sexual humiliation or sense of shame, within the G public toilets located in the 1st floor in Daegu-gu B, Daegu-gu, as described in the foregoing paragraph, by photographing the victim’s name in a manner such as that described in the foregoing paragraph (a).

C. On October 19, 2014, at around 03:48, the Defendant taken pictures of the victim’s name in the same manner as the written in the foregoing paragraph, in which the victim’s name and incompetences are reported, and taken against the victim’s body against his/her will that may cause sexual humiliation or abruption.

2. The accused who violates the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes shall be placed at the time and place specified in paragraph (1);
