The defendant shall be innocent.

1. On March 25, 2003, at around 11:38, the summary of the facts charged, B, a driver of a vehicle with a 15 tons car owned by the Defendant, loaded the 4 sn beam on the above vehicle at the street above the 32.2 kilometer of the 32.2 km in the direction of a mountain direction at the center of an entertainment business office located outside Seoul, and operated the 11.2 tons, while operating the sn beam on the road above, violated the restriction on vehicle operation by the road management authority, and the Defendant committed such a violation.

2. The former Road Act (amended by Act No. 4920 of Jan. 5, 1995, and amended by Act No. 7832 of Dec. 30, 2005) which is the legal provision applicable to the instant case, Article 86 of the Constitutional Court Decision 2010Hun-Ga14, 15, 21, 27, 35, 38, 44, 70 (merged) retroactively becomes void due to the decision of unconstitutionality as of Oct. 28, 2010. The decision of not guilty is made pursuant to the former part of Article 325 of the Criminal Procedure Act.
