Reasons
Punishment of the crime
1. Defendants’ status and crime planning Defendants entered the Republic of Korea around August 21, 2016 as China’s shipbuilding capacity.
The telephone financial fraud organization refers to a false telephone call to many unspecified persons in Korea while operating the call center. It plans and instructs a criminal act of acquiring money by means of a “scaming,” in which money is remitted from those persons, and takes part in the role of “passbook solicitation”, “passbook delivery”, “passbook delivery”, “passbook immediately withdrawing the money transferred from the victims in cash,” and “transfer account”, etc. to transfer the money back to the country.

B) Around August 26, 2016, upon introduction of “D”, which was known to the general public, introduced the following: (a) one person who was suspected of being the upper member of the Red Cross Organization (E) and kept in custody after delivery of the passbook and the check card to be used for the crime of Bosing; (b) he/she immediately withdraws the money in cash when it was transferred to the account; and (c) he/she agreed to receive 4% of the amount of the withdrawal at the time of the settlement of the account deposited into the designated account; and (d) around August 29, 2016, Defendant A promised to receive 4% of the amount of the withdrawal in return for the said crime after introducing the above day through B and keeping the means of access, such as the check card, with B, and promised to take part in the said crime.
2. No person who violates the Electronic Financial Transactions Act shall borrow or lend a means of access or keep, deliver or distribute a means of electronic financial transactions with intent to use the means of access for a crime or knowing that such means are to be used for a crime;
