The prosecutor's appeal is dismissed.

1. The sentence of the court below (2 million won in penalty) on the summary of the grounds for appeal is deemed to be too unhued and unfair.

2. The Defendant’s judgment interfered with the performance of official duties by insulting and assaulting a police officer who performs his/her legitimate duties, which is light of the public authority, and the nature of the offense is not weak.

However, the defendant reflects the crime, and has no criminal record exceeding the same kind of criminal record and fine.

In addition, comprehensively taking into account all other circumstances such as the defendant's age, sex, environment, family relationship, motive and circumstance of the crime, and circumstances after the crime, the sentence of the court below is too uneasy and unreasonable.

Therefore, prosecutor's assertion is without merit.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
