The judgment below

In light of the records, the court below reversed the judgment of the court of first instance which found the defendant guilty on the grounds that the facts charged in this case constitute a case where there is no proof of facts constituting the crime, and sentenced the defendant not guilty. There is no violation of the law of logic and experience and the limitation of free evaluation of evidence, or misapprehension of the legal principles on forced indecent act, as alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
