가. 당사자의 지위 1) 피고 삼성제약은 의약품 등의 제조 및 판매업 등을 영위하는 회사이고, 피고 주식회사 내츄럴바이오(이하 ‘피고 내츄럴바이오’라 한다

)는 건강기능식품 제조업 등을 영위하는 회사이다. 2) 원고는 표장을 ‘호간보’로 하는 등록상표(출원연월일 C, 등록연원일 D, 지정상품 제29류) 외에 ‘호간보’나 그 한자표기인 ‘護肝寶’를 표장으로 사용하는 다수 등록상표의 권리자이다
