A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. The Defendant’s wage-related fraud (2017 high group 2553) around March 12, 201, the Defendant would pay wages immediately after the completion of the construction work, even if he was entrusted with the construction work to the victim D at the Cweing shop located in Gwangju Dong-gu, Gwangju, by calculating the amount of KRW 30,000 per the face of the week of another construction work, even though he did not have the intent or ability to pay wages.
“Falsely speaking, the victim did not pay KRW 2,315,000 to a total of three days from around that time until March 15, 201, and did not pay KRW 2,315,000 to the victim’s pecuniary profit.
2. Each fraud related to the use of credit cards (2017 order 1200) suggested that the Defendant was dead of the victim’s name in the name of his/her employee in the F funeral hall in Gwangju North-gu, Gwangju, as if he/she had legitimate right to use the card, and that he/she had the victim pay 5,300,000 won of funeral expenses, thereby having the victim pay 5,30,000 won of the same amount, and then, from around that time to November 2, 2012, the Defendant acquired a total of 6,186,200 won from the victims every four times in total, such as the first half of the list of crimes in attached Form 1.
3. Each theft related to the use of a credit card (200 senior 1200) committed a theft of cash amounting to KRW 2,400,000,000 from the victims on five occasions in total, including the following five occasions from around the following day to November 2, 2012: (a) the Defendant identified the Defendant’s death on the part of the Defendant who died in the ATM equipment in the management device of the victim Gwangju Bank; (b) input the identification card in the name of G; and (c) withdrawing the password without authority; and (d) withdrawing KRW 2,00,000 from the victim’s bank by applying for cash services.
4. On December 29, 2016, each night building intrusion theft (2017 high group 1200) Defendant: (a) opened an unlocked entrance in front of the “I” restaurant located in Gwangju Northern-gu, Gwangju; and (b) intruded into the restaurant.
