Defendant shall be punished by imprisonment with prison labor for two years and fine for 200,000 won.
However, the above imprisonment for a period of three years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
[criminal history] On July 9, 2014, the Defendant was issued a summary order of a fine of five million won for a violation of road traffic law at the Suwon Flag Flag on the ground of the violation of the Road Traffic Act, and the Defendant had two criminal records of the same kind.
[Criminal facts]
1. Around 02:00 on September 13, 2020, the Defendant, while under the influence of alcohol driving, driven C rocketing car at approximately 4 km from the front of the Gu Park Park Park 12-20, to the front road of the Gag-gu Gung-gu Gag-ro, Gi-gu, Gigi-ro, Gigi-ro, Gigi-gu, Gigi-gu, Gigi-gu, Gigi-gu, Gigi-gu, Ligi-gu, Kigi-gu, Ligi-gu.
2. To the extent that the identity of the facts charged is recognized based on the evidence duly adopted and investigated by this court, and the correction of some of the facts charged ex officio shall be made to the extent that it does not cause disadvantages to the defendant’s defense right.
The Defendant, at the time of the day set forth in paragraph 1, tried to drive the said rocketing car, which was parked in front of the 12-20 Gugdong-ro 12-3, Gagdong-ro 12-20, Gagdong-ro, Young-gu, Gagdong-ro, at the night of the day set forth in the above paragraph 1, and went away without taking necessary measures to damage the property to ensure that the amount of repair costs would go against the left part of the Defendant’s vehicle, which was parked in front of the said Dogdong-ro 12-20, and D and other passengers were parked in front of the front.
3. On September 13, 2020, the Defendant violated the Road Traffic Act: (a) while driving the said rocketing car under the influence of alcohol as stated in paragraph (1) on the front of the apartment apartment house set up in Yeongdeungpo-gu G Apartment-gu G apartment on September 13, 2020; (b) while under the influence of alcohol, the Defendant immediately stopped and escaped without providing personal information to the victim, while driving the said rocketing car on the right-hand part of the Defendant’s vehicle, which is parked on the road right-hand.
