1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On March 31, 1970, the deceased B (the husband of the Plaintiff died around May 17, 2016) completed the registration of transfer of ownership on the ground of sale on March 17, 1970 with respect to 1/2 shares in each of the lands listed in attached Tables 1 through 3, 1970. On November 18, 1971, the registration of transfer of ownership is completed on the ground of sale on November 3, 1971.
On July 13, 2016, the Plaintiff completed the registration of ownership transfer by inheritance by consultation and division on May 17, 2016, with respect to each 1/2 shares among each land (hereinafter “instant land”) listed in attached Tables 1 through 4 (hereinafter “instant land”).
B. Since the 1960s, when farmland in Yangju-gun, E Ri, and Fri-ri, a branch of the Han River, which is a branch of the Han River, was habitually damaged each year, residents of the region concerned filed a petition to build a bank in the above area in order to prevent habitually harmful damage to the government, including Gyeonggi-do, around 1964. The Governor of the Gyeonggi-do enacted a river by Act No. 892 of Dec. 30, 1961 and enforced January 1, 1962; hereinafter “Seoul River Act”) on March 1, 1965 pursuant to the former River Act (amended by Act No. 892 of Dec. 30, 1961; hereinafter “Seoul River Act”), designated C as G to which Gyeonggi-do’s announcement was applied mutatis mutandis, and publicly announced the name and its section.
C. The Gyeonggi-do, through the “C Postal Control Promotion Committee” comprised of local residents, commenced the construction of Han River and the C bank construction (hereinafter the “instant construction”) on October 1967 and completed the construction on February 24, 197, thereby establishing a bank of the name “H” (hereinafter the “instant bank”).
The above bank promotion committee collected beneficiary contributions from the beneficiary owners due to the construction of this case, and paid compensation to the landowner of the land to be incorporated in the bank.
