A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of one year.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
"2016 Highest 1779"
1. On August 20, 2016, Defendant A made a false statement to the Defendant’s residence located in Seojin-gu G and 203, stating that “Aphone 64 equipment is sold” was posted on the website website, and reported to the Victim H H who contacted the Defendant.
However, there was no intention or ability to sell money from the injured party because the above son did not hold the phone.
On August 20, 2016, the Defendant: (a) by deceiving the victim as above; (b) received KRW 400,000 from the former North Korean bank account (I) in the name of the Defendant on August 20, 2016; and (c) received KRW 400,00 from September 15, 2016, a total of KRW 2,480,000 by the same method as in [Attachment Table 1] was transferred from the victim to September 15, 2016.

2. The Defendants: (a) stolen the mobile phone between the customers locked and locked in a soup room in the front week; and (b) gathered to raise entertainment expenses, etc. by selling it.
A. As a result, the defendants stolen the victim's property together.
B. On July 3, 2016, at around 07:00, the Defendants discovered that the victim O set up a soup room of “N” located in Yansan-gu M on the surface of the water at that place and set up a cell phone side by the victim O on the surface of the water.
