The sentence of sentence against the defendant shall be suspended.

Punishment of the crime

The defendant of "2014 High 192" is the user who runs the taxi transport business using 98 full-time workers, who are the representative director of the D(ju) located in Seojin-gu Seoul Special Metropolitan City(Seoul).

An employer shall pay workers to whom the minimum wage is applied wages not less than the minimum wage amount determined and publicly announced by the Minister of Employment and Labor each year (the minimum wage rate of 4,110 won during the period from January 1, 201 to December 31, 2010).

Nevertheless, the defendant is working as a driver from March 25, 2010 to December 10, 2010 at the above workplace.

In paying wages to retired E from office from July 2010 to December 2010, as shown in attached Table 1, the hourly wage of less than 4,110 won at the minimum wage rate of 2010 is paid from 2,349 to 2,400 won.

(b) When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the defendant is working as a driver from March 25, 2010 to December 10, 2010 at the above workplace.

The retirement E shall not pay KRW 1,830,307 below the minimum wage amount from July 2010 to December 2010, as shown in attached Table 1, within 14 days from the date on which the cause for the payment occurred without agreement between the parties to the extension of the due date.

The defendant of "2014 High 250" is the user who runs the taxi transport business using 90 full-time workers as the representative director of the D (ju) in Seojin-gu Seoul Special Metropolitan City.

An employer shall not be less than the minimum wage rate of 4,110 won at the minimum wage rate, and not less than the minimum wage rate of 4,320 won, during a period from January 1, 201 to December 31, 201, determined and publicly announced by the Minister of Employment and Labor, for workers to whom the minimum wage is applied, during the period from January 1, 201 to December 31, 201.
