Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment for four months.
However, this judgment is delivered against Defendant B.
Reasons
Punishment of the crime
[Criminal Power] On April 2, 2010, Defendant A was sentenced to ten months of imprisonment for a violation of the Punishment of Violences, etc. Act (joint injury) at the Daejeon District Court on April 2, 201 and completed the execution of the sentence in the Daejeon Prison on January 30, 201.
【Criminal Facts】
1. Defendant A
A. On July 19, 2013, at around 04:45, the Defendant driven a FMW car under the influence of alcohol content of 0.147% from the Defendant’s house located in Seo-gu Daejeon, Seo-gu, Daejeon to the front day of the Sambu apartment located in the Seo-gu, Daejeon.
B. On July 19, 2013, around 04:45, the Defendant: (a) expressed that he was suspected of driving a FMW car on the front side of the TMW car in the Tae-dong, Jung-gu, Daejeon; (b) he was aware of the suspicion that he was under the influence of alcohol; and (c) he was aware that he was driving the FMW car on behalf of the above place; and (d) around that time, at the “H” point in the Seo-gu, Daejeon, Seo-gu, Daejeon, B asked the investigative agency to state that B was waiting for the Defendant by driving the said car from the above control place to the above control place; and (c) on August 13, 2013, B made a false statement as above.
Accordingly, the defendant had B make a false statement, thereby inducing B to escape from committing a crime.
2. Around August 13, 2013, Defendant B made a false statement to the Daejeon Middle-gu Police Station located in Daejeon Jung-gu, Daejeon, to the effect that “A would drive a FMW car on July 19, 2013 and move to the front of the third apartment in the Tae-gu, Daejeon, Daejeon, and that “A would go to the front of the third apartment in the Tae-gu, Daejeon.”
As a result, the defendant got A who committed a crime corresponding to a fine or heavier punishment to escape.
