The prosecution of this case is dismissed.
Reasons
1. On October 9, 2017, the Defendant committed assault on the part of the victim D (58 taxes) and franchising in the construction site located in C at permanent residence around October 17, 2017, with the victim’s d (58 taxes).
2. The above crime is a crime falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act.
In this regard, on November 16, 2018, after the victim D was prosecuted, the victim expressed his/her wish not to punish the defendant in this court. Thus, the prosecution of this case is dismissed in accordance with Article 327 (6) of the Criminal Procedure Act.
