The prosecutor's appeal is dismissed.

1. The sentence of the court below (the suspended sentence for four months of imprisonment) is too unhued and unreasonable.

2. In light of all the sentencing conditions stated in the instant pleadings, including the Defendant’s age, character and behavior, environment, motive, means and consequence of the instant crime, etc., the sentence imposed by the lower court is deemed appropriate and it is deemed unfair because it is too unreasonable, and thus, the Prosecutor’s above assertion is groundless.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
