1. 폭력행위등처벌에관한법률위반(공동상해) 피고인들은 2013. 5. 15. 13:00경 서울 용산구 D에 있는 피해자 E(23세)의 집을 찾아 가, 피해자가 평소 동네에서 자신들에 대한 험담을 하고 다닌다는 이유로, 피해자에게 “문을 안 열면 부숴버리겠다”라고 위협하여 문을 열도록 한 후, 피해자를 서울 용산구 F에 있는 피고인 A의 집으로 끌고 갔다.

피고인들은 같은 날 13:30경 피고인 A의 집 작은 방에서 두루마리 화장지를 주먹에 말아 피해자의 얼굴과 가슴 부위를 수회 때리고 발로 허벅지를 걷어찼다.
